Turkey: Public Policy Advocacy

The Challenge

A global consumer products company faced onerous and unfair treatment under a legacy import duties and tax regime in Turkey. Judicial proceedings threatened fines and frozen assets, as well as possible penalties to individual employees. The company was contemplating an exit from the market.

Our Approach

Our team in Turkey developed a strategy to build upon our client’s limited set of existing relationships in the national and local governments, including the Turkish Customs Authority. Through a sustained engagement effort we expanded that network, allowing our client to reach other key policy makers. Patience was the key to our process. For over three years and dozens of meetings we were able to engage various jurisdictions and levels of government, raising awareness of the discriminatory nature of the tax policies and reinforcing the negative impact the current regulations had on Turkey's economy. Our team worked tirelessly to explain and propose solutions beneficial to both the company and the government. Leveraging ASG’s global network we identified and put forth case studies from other markets as possible options for resolution of the issue.

The Result

As a result of our efforts, legislation was enacted that paved the way for our client and other similarly situated companies to resolve their financial disputes, thereby allowing our client to maintain a strong presence in Turkey and actually increase its level of investment. This major policy reform unlocked billions of dollars of value for our client, and resulted in a major economic boon for the Turkish economy.

Public Policy Monitoring and Advocacy

The Challenge

A major professional services firm faced a new and uncertain regulatory environment in Europe in the aftermath of the global financial crisis and a new legislative landscape stemming from EU governance changes enacted through the Treaty of Lisbon. Proposed legislation threatened very substantial impacts to the company's business model.

Our Approach

We began by helping our client understand the new regulatory environment in Europe, including the decision-making process, key stakeholders and possible legislative trajectory. As the legislation advanced, ASG provided strategic counsel to the client on messaging and positioning. Our team on the ground in Brussels engaged in discussions with key legislators and regulators on a sustained basis, clarifying the importance of firms in our client's sector to the EU economy and the negative impacts on Europe that were likely to result from the proposed laws. Through these dialogues we framed an approach that mitigated the negative effects of the legislation for all parties.

The Result

Successful advocacy resulted in changes to problematic legislative clauses, and blunted the most negative effects of the new laws. Throughout the process, ASG advised the client on adjustments to its posture and helped them weigh the opportunities to make positive inputs into the policy shaping discussion against those aspects of the new legislation that would be unwelcomed but inevitable.  

Brazil: Successful Public-Private Partnerships

The Challenge

The Brazilian government is among the world’s largest purchasers of pharmaceutical products, but regulatory processes can also create significant hurdles. Our client came to us having entered a public-private-partnership intended to bring an important life-sustaining product and technology to Brazil. However, implementation was being held up amid legal uncertainty over the partnership agreement and potential opposition from an incumbent competitor.

Our Approach

Understanding the great value that our client’s products offered to Brazil our approach was to raise and enhance our client’s profile, highlighting areas of mutual benefit and building trust with stakeholders in order to overcome skepticism of public-private partnerships with multinational drug makers. We worked with the client to implement an outreach plan to counter interference from competitors, strengthen relations with its local public sector partner, and effectively work through the regulatory process. Ongoing dialogue with stakeholders, such as the Ministry of Health, key legislators, and health organizations, was built public support and securing a positive outcome.

The Result

Our client’s partnership was successfully implemented, opening the market to their flagship product and providing thousands of Brazilian patients with the most advanced treatment option. The company now operates from a solid foundation for continued growth in Brazil.
